Online casino, poker, keno and the sports lottery: Delaware Gaming
Competitiveness Act of 2012 (House Bill 333, 146th General Assembly),
signed 28 June 2012, amending Title 29, Chapter 48 of the Delaware Code.
Is online gambling legal in Delaware? Yes. Online casinos, sports betting, and daily fantasy sports are all legal and regulated by the state. Prediction markets are a separate case because they are regulated at the federal level, not by Delaware.
The state launched its online casino market in November 2013, becoming one of the first three states in the country to do so.
Online casino play became legal in Delaware in November 2013 under the Delaware Gaming Competitiveness Act. To answer the question, “Is there a casino in Delaware?” Yes, there are three casinos in the state: Delaware Park, Bally's Dover, and Harrington Raceway.
All three are part of the state lottery system. If you look at a Delaware casino map, you'll see they are located near the main population centers. None of them operate as Delaware state casino brands outside the shared lottery platform.
Delaware became the first state outside Nevada to allow single-game sports bets in June 2018 after the federal ban ended. Online sports betting started in December 2023, also through the same three casinos.
Daily fantasy sports have been legal in Delaware since 2017.
Prediction markets are handled differently. They are regulated at the federal level by the CFTC as event-contract exchanges, and Delaware law does not apply to them. There is no Delaware license for this type of gambling.
Delaware casino age for legal gambling is 21. The same minimum applies to sports betting.
The Division of Gaming Enforcement, which is part of the Department of Safety and Homeland Security, licenses gambling operators and handles complaints. The Delaware Lottery, under the Department of Finance, manages the platform and works with the three licensed casinos. If you have a complaint, contact the Division of Gaming Enforcement.
For support, you can call the Delaware helpline at 1-888-850-8888, which is run by the Delaware Council on Gambling Problems, or visit our responsible gambling page.
Delaware operates online gambling as a state lottery monopoly with three licensed casinos: Delaware Park, Bally's Dover, and Harrington Raceway. If you are searching for “Where is Delaware Park casino located?” It is located near Wilmington.
Like the other two, it also serves as a Delaware casino resort, offering both retail gaming and online play. All three use a single shared platform provided by Rush Street Interactive.
You can play slots, table games, and video poker through the shared online platform. Delaware's online casinos section explains what games are available.
BetRivers is the only licensed online sportsbook in Delaware. Delaware's sportsbooks page explains the available betting lines, markets, and how betting works
Daily fantasy sports are licensed separately from casinos and sportsbooks. Delaware's DFS options cover the operators available.
There is no Delaware-specific page for prediction markets because they are not covered by state law. To check the current status, use the prediction market regulatory tracker.
In Delaware, gambling winnings are considered taxable income. The highest personal income tax rate in the state is 6.6%, which applies to larger winnings.
What an operator withholds at the point of payout can differ from the final tax bill after you file a full return. This is general information, not tax advice. If you have a specific situation, you should consult a tax professional.
As of September 2026, there are no active gambling bills in the Delaware legislature. Earlier in the year, a bill to allow more online sports betting operators passed the House, but the Senate Gaming Committee stopped it. No new proposals have come up since then.
Delaware has never passed a specific law banning sweepstakes casinos. This is unnecessary because all online gambling in the state runs through the lottery under a closed licensing system. Sweepstakes operators cannot legally accept players from Delaware.

As of 2 September 2026, no gambling bills are moving in the Delaware legislature. The last serious attempt was House Bill 365, introduced in April 2024, which would have ended the Delaware Lottery's online sports betting monopoly by letting each of the three casinos partner with up to two operators. It cleared the House Administration Committee but stalled in House Appropriations and did not become law. Nothing has replaced it since.
Delaware has never passed a law specifically banning sweepstakes casinos. It has not needed one. All online gambling in the state runs through the lottery under a closed licensing structure, so there is no lawful route for a sweepstakes operator to take Delaware play. The state has enforced that position. In April 2025, the Division of Gaming Enforcement issued a cease-and-desist order to VGW Luckyland, with the support of the Delaware Lottery, after finding it had presented paid casino-style games as a promotional sweepstakes. Delaware residents lost access on 2 April 2025.

You must be 21 years old to play online casino games or place sports bets in Delaware, and physically located in the state. Licensed sites check your location with geolocation before you place a bet. The state lottery allows a lower age; it is sold to anyone 18 or older, but this doesn't apply to casino or sports betting.
There are three legal online casinos in Delaware, all operated through the Delaware Lottery: Delaware Park, Bally's Dover, and Harrington Raceway. They all use a single shared platform provided by Rush Street Interactive, so their game selections are nearly identical. No other online casinos are legal in the state.
The Division of Gaming Enforcement, inside the Department of Safety and Homeland Security, licenses operators and investigates complaints. The Delaware Lottery, inside the Department of Finance, runs the platform and contracts with the three licensed agents. The Delaware helpline is 1-888-850-8888, free and confidential.
