North Dakota has never legalized commercial casino gaming or state-regulated sports betting. That said, everything runs through Class III compacts with the state's 5 tribes.

Who Regulates Gambling in North Dakota

The Attorney General's Gaming Division

The Gaming Division inside the Attorney General's Office regulates charitable gaming. And the North Dakota Lottery sits in that same office.

What if you have a complaint about a pull-tab machine at your local bar? It’s good to know who handles it.

Tribal Gaming Commissions

Each tribal nation runs its own gaming commission under its own compact. That's separate from the state. And there's no commercial gaming regulator or state sports betting regulator here at all.

That's also why you won't find published figures, the kind of thing a licensed state market puts out.

Where to Get Help in North Dakota

There's an option to call the Gamblers Choice helpline at 1-877-702-7848. Or, you may dial 2-1-1 for the statewide responsible gambling line.

The state's Health and Human Services department runs the program. It also has free counseling and a screening tool if you're not sure whether it's truly a problem yet.

Where You Can Bet in North Dakota

Sportsbooks in North Dakota

Betting in North Dakota happens only at tribal casinos that run it, under compact rather than state sportsbook license.

There's no licensed online operator to point you to. That said, if you're looking to bet from your couch outside reservation land, the honest answer is that you can't do it legally.

DFS in North Dakota

Daily fantasy sports operators run in the whole state through the same apps you'd expect. Still, they’re separate from the tribal casino restriction that governs sports betting.

What Is Not Available Here

No online casino page exists, because nothing legal exists to send you to.

That's also true for regulated poker. If a site claims otherwise, we see it as a red flag.

Tax on Gambling Winnings in North Dakota

North Dakota State Tax on Winnings

North Dakota's top marginal income tax rate is 2.50%, the lowest of any state that taxes income.

A 0% bracket covers most filers, with 1.95% and 2.50% above it. So a lot of residents end up owing nothing on their winnings once you factor in where their income lands.

What Gets Withheld and When

Winnings from a tribal casino still count as taxable income for a North Dakota resident. Being on tribal land doesn't change your state or federal tax position at all.

Larger jackpots may have withholding applied right at the casino, similar to how it works elsewhere in the country. Yet, know that this is general information. If your situation is more complex than a single win, always consult a professional.

Pending North Dakota Gambling Legislation

Sports Betting Needs a Ballot Measure

A real state-licensed market would need a constitutional amendment. That means voters decide too, not just lawmakers. The closest it came was 2023. The House narrowly passed HCR 3002, 49-44, but the Senate killed it, 16-30.

A second attempt at the same bill happened in January 2025, but it failed with a vote of 70-24 in the House.

Why Nothing Moves Until 2027

North Dakota's legislature meets only in odd-numbered years. So 2026 had no regular session.

No online casino bill has ever been introduced, either. As of this writing in September 2026, the earliest another attempt could surface is 2027.

Frequently asked questions

Is online gambling legal in North Dakota?

Barely, and not the way most states handle it. Sports betting and daily fantasy sports are legal. Still, sportsbooks run inside tribal casinos under federal compacts, not a state law, and there's no statewide mobile market. Online casino games aren't legal anywhere in the state.

Is sports betting legal in North Dakota?

Yes, but only in person at tribal casinos that choose to offer it. There's no state license and no online sportsbook, since North Dakota has never passed its own sports betting law. Creating a state-regulated market would take a constitutional amendment approved by voters.

Are online casinos legal in North Dakota?

No, they are not legal. North Dakota has never authorized them, and no bill has ever proposed one. Casino gaming here stays tribal, on tribal land. Sweepstakes casinos are a separate category and are not banned in North Dakota, which is why you may still see them advertised.

How old do you have to be to gamble in North Dakota?

19 is the minimum age at tribal casinos, which covers both sports betting and casino games, since a 2022 compact lowered it from 21. The lottery, charitable gaming, and pull tabs stay at 18. Check the age for the specific product rather than assuming it carries across.

Who regulates gambling in North Dakota?

It depends where you're playing. The Attorney General's Gaming Division handles charitable gaming and the lottery. Tribal casinos answer to their own gaming commissions under compact. There is no commercial gaming or state sports betting regulator, so complaints go to whichever body oversees the product. Do you need help? Call 1-877-702-7848.
