Guide coming soonSports betting is legal in Florida, but only through one operator. Online casino has no licensed commercial market. Here is what you can legally bet on in Florida, who regulates it, and why the Seminole compact decides all of it.
2021 Tribal-State Gaming Compact between the Seminole Tribe of Florida and the State, signed by Governor DeSantis in April 2021 and ratified by the Legislature in May 2021. A 30-year compact running to 2051, granting the Tribe exclusivity over sports betting through a hub-and-spoke model. Upheld when the US Supreme Court denied certiorari in West Flagler Associates v. Haaland on 17 June 2024. Florida Gaming Control Commission created in 2021 under Chapter 16, F.S.
Is gambling legal in Florida? We found that sports betting is legal and runs entirely through Hard Rock Bet under the Seminole Tribe's compact. Daily fantasy sports operates here too, just without a clear legal status. Online casino Florida searches turn up nothing, though, because Florida has no licensed commercial online casino market. Prediction markets also sit outside Florida law entirely. Here's what defines this market: Florida is the largest state in the country with only one licensed sportsbook operator.
The majority of players ask one question: Is online gambling legal in Florida? Yes, and only through Hard Rock Bet. Governor Ron DeSantis signed the Seminole Tribe's gaming compact in April 2021, and Florida's legislature ratified it that May.
Legal challenges shut the app down within months, though. What’s more, the app didn't fully relaunch until December 2023. This happened after a federal appeals court sided with the tribe. The Supreme Court refused to hear a further challenge in June 2024, which settled the matter for good.
This is quite complicated. Florida has no law that specifically legalizes or bans daily fantasy sports, so it sits in a gray area. DraftKings and FanDuel both operate openly here anyway, and neither has faced a real challenge.
Lawmakers have tried and failed several times since 2021 to pass a law regulating DFS. Now, this is partly because doing so risks conflicting with the Seminole compact.
Is online casino legal in Florida? Not commercially. Casino games exist only on Seminole tribal land, under the compact's hub-and-spoke setup. That's a real, specific legal position. Keep in mind it’s not the same as an outright ban on online casinos.
One thing to remember: any site claiming to offer real-money Florida online casinos isn't licensed here. That means you're on your own if something goes wrong.
The CFTC regulates prediction markets federally and treats them as event-contract exchanges.
Florida law doesn't touch them, and no Florida license exists for this category.
So what about Florida sports betting and the minimum gambling age now?
Florida gambling age depends on what you're playing. Seminole casinos and sports betting both require you to be 21. Pari-mutuel wagering and the Florida Lottery only require 18.
Let’s discuss regulation for a moment. Namely, the Florida Gaming Control Commission, created in 2021, regulates state-licensed gaming activity.
All in all, this one body oversees most of the Florida gambling laws.
Everything on Seminole land, including Hard Rock Bet itself, falls under the Seminole Tribal Gaming Commission instead.
If you have a complaint about Hard Rock Bet specifically, this is who handles it, not the state commission.
It’s always good to know that you can call 1-833-PLAYWISE for help.
That is Florida's own current responsible gambling number, run through the Florida Gaming Control Commission, not the national line you'll see in most other states.
Regulator information is being verified.

Guide coming soonThe Seminole Tribe holds full sports betting exclusivity under its 2021 compact. Hard Rock Bet is the only legal sportsbook in Florida. No other app, no matter how big its name, can legally take a Florida bet.
Is DraftKings legal in Florida? Not for sports betting, based on the newest resources. Still, is FanDuel legal in Florida by any chance? No, same answer. Neither holds a sportsbook license here, and neither can under the current compact. Both do offer daily fantasy sports, though, which is a separate legal category from sports betting. If you've searched FanDuel Florida expecting a sportsbook, DFS is what you'll actually find.
Speaking of what’s not available, there are no commercial online casinos in Florida. Online poker isn't available here either. Prediction markets are federally regulated. Check our prediction markets tracker to see what's live in the state.
There’s one interesting fact here. Florida charges no state personal income tax at all, so your gambling winnings owe nothing to the state. Did you know that Florida is one of 9 states with no state income tax in 2026? Many states with legal sports betting still take a cut of your winnings, some well into double digits. Florida just doesn't. That puts it in the same small club as Texas and Nevada, rather than most of its East Coast neighbors.
You should know that federal tax still applies, though. Once you cross certain thresholds, operators send you a W-2G form. Just know this is general information, not actual tax advice.
General information only; not tax advice.
The Seminole compact runs to 2051, locking in the tribe's exclusivity for that entire stretch. A real competitive market, an online casino or a second sportsbook, would require renegotiating the whole compact rather than just passing a new state law. That fact alone explains why nothing else is moving here.
Florida's 2026 legislative session ended in March without passing any gambling reform, sweepstakes-related or otherwise. Several bills touched on dual-currency and internet gambling systems, the language that would've covered sweepstakes casinos, but none made it into law. Virginia, Massachusetts, and Mississippi saw similar bills stall that same year. Another attempt is expected in 2027.
Partly. Sports betting is legal under the Seminole Tribe's 2021 gaming compact. Daily fantasy sports operates in an unregulated gray area and is neither licensed nor banned. Casino gaming is limited to Seminole properties and pari-mutuel cardrooms, so no commercial online casino market exists.
Only in a narrow sense. Sports betting is legal and regulated, through one operator. Daily fantasy sports operates without regulation either way, neither licensed nor banned. No commercial operator offers online casino games in the state, and none can under the current compact.
Yes, but only through one operator. The Seminole Tribe's 2021 compact gives it exclusivity, so Hard Rock Bet is the sole legal sportsbook in Florida. The market fully relaunched in December 2023, and the U.S. Supreme Court declined to hear a challenge in June 2024.
Not for sports betting. The Seminole Tribe holds exclusivity under the 2021 compact, so Hard Rock Bet is the only licensed sportsbook in Florida, and DraftKings can't operate one there. DraftKings does offer daily fantasy sports here, but that operates in an unregulated space.
No. Florida has no licensed commercial online casino market. Casino games exist only on Seminole tribal land under the compact's hub-and-spoke model. Any site advertising a Florida online casino is offshore and unregulated, which means you have no recourse if something goes wrong.
It depends on the product. You must be 21 for Seminole casinos and for sports betting. Pari-mutuel wagering and the Florida Lottery require you to be 18. Florida sets no single statewide gambling age. So, always check the requirement for the specific product before you play.
