House Bill 904, the Wagering Consumer Protection Act, filed 4 March 2026, passed House 64-19 and Senate 24-13, vetoed 13 April 2026 and overridden 14 April 2026; effective mid-July 2026, raising the sports betting and charitable gaming age to 21, banning negative-outcome prop bets on Kentucky college athletes, licensing fantasy contest operators, barring Kentucky licensees from offering prediction market products in-state, and legalizing fixed-odds wagering on horse racing. House Bill 757, imposing a 14.25% excise tax on unlicensed prediction market operators from 1 January 2027. Kentucky has no casino statute. Income tax cut to 3.5% on 1 January 2026 under House Bill 1 (2025).

So, is betting legal in Kentucky? Sports betting is legal in Kentucky, and daily fantasy sports now got real licensing this year too. Online casino gambling isn't legal here at all. Here's the part that surprises most: Kentucky has no casinos, period. What you'll find instead are historical horse racing machines at the tracks, legally pari-mutuel devices, not casino games. And here's a number worth knowing: the sports betting age just jumped from 18 to 21 in July 2026.

Who Regulates Gambling in Kentucky

The Kentucky Horse Racing and Gaming Corporation

This agency used to be called the Kentucky Horse Racing Commission, but that changed a while back. The Kentucky Horse Racing and Gaming Corporation now regulates horse racing, pari-mutuel wagering, sports wagering, charitable gaming, and, as of this year, daily fantasy contests too, all under one roof.

Prediction market operators remain federally regulated by the CFTC.

How to File a Complaint

There's no separate casino regulator, because there's nothing to regulate. Complaints about a licensed sportsbook or fantasy operator go right to the Corporation instead.

Where to Get Help in Kentucky

Call 1-800-GAMBLER for help. It's Kentucky's statewide responsible gambling line, and every licensed operator has to display it.

Still, there is one more interesting thing to know. Anyone more than $1,000 behind on child support is blocked from wagering entirely, using a list the Attorney General's office supplies directly to operators.

Licensed Sportsbooks in Kentucky

Nine online sportsbooks currently hold a license in the state:

  • DraftKings,
  • FanDuel,
  • BetMGM,
  • Caesars Sportsbook,
  • theScore Bet,
  • Fanatics Sportsbook,
  • Circa Sports,
  • bet365, and
  • Prime Sports, the newest addition.

Every single sportsbook has to partner with a licensed racetrack for market access. That's why you'll see apps tied to specific tracks like Churchill Downs, The Red Mile, or Turfway Park, rather than operating on their own.

Fantasy Sports Operators

Two new HB 904 restrictions are worth knowing directly in regards to DFS. Prop bets targeting individual Kentucky college athletes, mainly wagers betting on a player to underperform or fail, are now banned.  Bets on out-of-state college players and team-level wagers aren't affected by this. Licensed sportsbooks also can't offer prediction market products inside Kentucky anymore. That is a direct result of that same bill.

Check our prediction market tracker to see if operators such as Kalshi are live.

What Is Not Available

No Kentucky casinos exist, licensed or otherwise, anywhere in the state.  It's worth noting that the same goes for online poker.

Tax on Gambling Winnings in Kentucky

Kentucky State Tax on Winnings

Kentucky taxes gambling and contest winnings as ordinary income, at a flat 3.5% for 2026, down from 4.0% the year before. That's separate from what operators pay.  Sports betting revenue gets taxed at 14.25% online and 9.75% retail. But that charge falls on the sportsbook, not on you as the player.

What You Still Owe Federally

Federal tax applies on top of whatever Kentucky takes. And operators send out a W-2G once your payout crosses the federal reporting threshold.

Pending Kentucky Gambling Legislation

HB 904: What Actually Happened in 2026

This is the part most coverage skips over. HB 904, the Wagering Consumer Protection Act, didn't pass quietly. Governor Beshear actually vetoed it on April 13, 2026. The legislature overrode that veto the very next day, and the law took effect July 13, 2026. HB 904 did more than just raise the age. It also legalized fixed-odds wagering on live horse racing for the first time. That revenue now feeds a new purse stabilization fund. One more thing worth flagging: this same bill raised the minimum age for charitable gaming to 21. You'll still see 18 listed on some older pages, but that's outdated now.

Prediction Markets and HB 757

A companion bill, HB 757, adds a 14.25% excise tax on prediction market operators like Kalshi and Polymarket that don't hold a Kentucky gambling license, effective January 1, 2027.

Online Casino: No Bill

Nobody has introduced online casino legislation in Kentucky, and there's no existing casino statute to amend or build on.  Any future push would have to start from scratch.

Frequently asked questions

Is gambling legal in Kentucky?

Partly. Sports betting is legal and licensed, and daily fantasy sports gained a licensing framework in 2026. Online casino gambling is not legal, and Kentucky has no casinos of any kind. The Kentucky Lottery, charitable gaming, pari-mutuel horse racing and historical horse racing machines at the tracks are all legal.

Is betting legal in Kentucky?

Yes. House Bill 551 was signed on March 31, 2023; retail sportsbooks opened on September 7, 2023, and online betting followed on September 28, 2023. Nine online sportsbooks are licensed, each partnered with a Kentucky racetrack. The minimum age rose from 18 to 21 in July 2026.

Are there casinos in Kentucky?

No. Kentucky has no commercial casinos, tribal casinos, or casino statute. The venues that show up in map results are gaming halls at racetracks offering historical horse racing machines, pari-mutuel devices rather than casino games. Legalizing casinos would require new legislation that has never passed.

What is the legal betting age in Kentucky?

21 for sports betting since mid-July 2026, raised from 18 by HB 904. Charitable gaming's minimum age also rose to 21 under that same law. The Kentucky Lottery and pari-mutuel horse racing remain open at 18. Any guide still listing 18 for sports betting predates the change.

Is online casino legal in Kentucky?

No. Kentucky has never authorized online casino gaming and no operator is licensed. No casino statute exists to amend, so legalization would have to start from scratch, and no bill has been introduced. Any site advertising a Kentucky online casino is offshore and unregulated.

Do you pay tax on gambling winnings in Kentucky?

Yes. Kentucky taxes gambling and contest winnings as ordinary income at a flat 3.5% for 2026, down from 4.0%. Federal tax applies on top of that, and operators issue a W-2G once a payout crosses the federal reporting threshold.
