Legal basis

Initiative 429 (2020), authorizing games of chance at licensed racetracks. LB 561 (2021), the Nebraska Racetrack Gaming Act, implementing it and permitting retail sports wagering.

Sports betting is legal in Nebraska, but only inside a licensed casino. Online casino games and paid daily fantasy sports aren't legal, and that's not changing this year either way. A betting app doesn't work anywhere in Nebraska outside a racetrack casino's property, no matter what the app store description promises.

Who Regulates Gambling in Nebraska

Notably, 2 different bodies handle gambling in Nebraska, and they don't overlap.

Let’s take a look below.

The Nebraska Racing and Gaming Commission

The Nebraska Racing and Gaming Commission licenses and polices the racetrack casinos and their sportsbooks.

If something goes wrong at a casino sportsbook, this is where you'd file a complaint.

Where to Get Help in Nebraska

The Nebraska Lottery runs separately, under the Department of Revenue. That means a lottery complaint goes elsewhere.

If gambling itself becomes a problem for you, make sure to call or text 1-833-BET-OVER (1-833-238-6837). It's free, private, and available 24 hours a day.

Paid DFS is the same story. Anything online claiming to offer either isn't operating legally in Nebraska. Prediction markets are federally regulated. Check our prediction markets tracker for the latest updates.

Tax on Gambling Winnings in Nebraska

Winnings count as ordinary income in the state of Nebraska.  For 2026, the top marginal rate dropped to 4.55%, down from 5.20% in 2025, under LB 754. Also, that rate is scheduled to fall again to 3.99% in 2027.

Larger payouts may have state withholding applied when you win, similar to federal rules.  This is general information, not tax advice, so check with an expert if your situation is more complicated than a single jackpot.

Pending Nebraska Gambling Legislation

The Ballot Measure Voters Will Decide

This is the part that changed the fastest. A legislative attempt to put mobile sports betting to a vote failed by one seat in a filibuster back in April 2025.  So supporters went around the legislature instead. They ran a petition drive, and it worked: the Secretary of State certified both measures for the November 3 ballot in late August. If voters say yes, the Racing and Gaming Commission has until June 2027 to write the actual rules.

What Isn't Moving

Online casino legislation hasn't seen the same push, still. We see that no bill exists, and no one is collecting signatures for one.  Sweepstakes casinos also remain legal here, since Nebraska hasn't introduced a ban like some neighboring states have. As of this writing in September 2026, that's the accurate picture.

Frequently asked questions

Is online gambling legal in Nebraska?

Only partly, and it depends on the category. Sports betting is legal but retail-only, meaning you have to be inside one of 4 licensed casinos to place a bet. Online casino games and paid daily fantasy sports aren't legal. Prediction markets currently operate here unchallenged, though that could shift given recent court rulings elsewhere.

Is sports betting legal in Nebraska?

No. Nebraska has never authorized real-money online casino games, and no legislation has ever proposed one. Sweepstakes casinos, a different category entirely, remain legal here, since the state hasn't passed any ban targeting them. So, if you're Googling online casino Nebraska hoping for a legal option, save yourself the trouble; there isn't one.

Are online casinos legal in Nebraska?

No. Nebraska has never authorized real-money online casino games, and no legislation has ever proposed one. Sweepstakes casinos, a different category entirely, remain legal here, since the state hasn't passed any ban targeting them. There's no statewide licensing system for online casinos in Nebraska the way other states have it.

How old do you have to be to gamble in Nebraska?

The minimum age for casino games and sports betting is 21. The Nebraska Lottery sets its own age at 19, matching the state's age of majority rather than the usual 18 you'll see quoted elsewhere. Check the age for the specific product rather than assuming it carries across.

Who regulates gambling in Nebraska?

The Nebraska Racing and Gaming Commission oversees the racetrack casinos and their sportsbooks. The Nebraska Lottery is handled separately by the Department of Revenue. Prediction markets have a federal designation by the CFTC. Online casinos are not regulated, so there's no commission or regulatory body designed for that purpose.
