Legal basis

Amendment 2 (part of the state constitution)

In Missouri, sports betting and paid daily fantasy sports are legal, but online casinos are not. Sports betting only started on December 1, 2025, and Missouri was the only state to launch that year.

DraftKings and FanDuel both run sports betting in Missouri under brand names most people already recognize. This can cause confusion when people search “If online gambling is legal in Missouri”, since seeing an ad for one type of gambling does not mean all types are legal.

Who Regulates Gambling in Missouri

The Missouri Gaming Commission is responsible for licensing and overseeing both sports betting and paid daily fantasy sports. If you have a complaint, this is the agency to contact.

Reach the Missouri Gaming Commission directly for any complaint.

Support runs through the Missouri helpline at 1-888-BETS-OFF (1-888-238-7633), funded by the Department of Mental Health. Licensed sportsbooks in Missouri also show the national 1-800-GAMBLER number. You can find more information on our responsible gambling page.

Ten sportsbooks were approved when Missouri launched sports betting. DraftKings and Circa Sports have untethered licenses, so they do not need a casino partner. The other sportsbooks are connected to one of Missouri's 13 riverboat casinos or to a professional sports team.

This is the practical answer to “Is online gambling legal in Missouri?” Sports betting runs through these ten operators specifically.

Paid daily fantasy sports have a completely separate licensing process. Missouri's DFS options cover who's currently available.

There is no Missouri-specific page for prediction markets because they are not covered by state law. The prediction market regulatory tracker is the right place to check current status instead.

Missouri State Tax on Winnings

In Missouri, gambling winnings are considered ordinary income. The state tax rate is graduated and will reach up to 4.70% in 2026. Missouri does not tax capital gains under HB 594, but this exemption does not apply to gambling winnings. These remain fully taxable as ordinary income.

What Gets Withheld and When

When you get paid, the operator takes out some money for taxes right away. That amount might not match what you actually owe when you file your tax return.

Why Online Casino Needs a Ballot Measure

Amendment 2 is part of the Missouri Constitution. Because of this, Missouri online casinos cannot become legal through a standard bill. Legalizing them would require another ballot measure.

What Is Not Moving

As of September 2026, Missouri has not introduced any bills to legalize online casinos. Bills for video lottery terminals have failed several times over the years. The 10% tax on adjusted gross sports betting revenue, which includes a promotional deduction, will likely be reviewed after a full year of revenue data is available.

Missouri's sports betting market has been active for eight months. In the most recent month, about $246.8 million was wagered, bringing in $2.2 million in state tax revenue. This was the highest revenue month so far, even though the total amount wagered was lower.
