Nevada was the first state in the US to legalize real-money online poker back in 2013. This is why a lot of people are confused and search "Is online gambling legal in Nevada?" To make it clear: sports betting, daily fantasy sports, and online poker are all licensed here.

Online casino games, meaning slots and table games, have never been authorized. There's also a rule found nowhere else: a player has to register in person at a casino before any betting app will work.

Who Regulates Gambling in Nevada

Two organizations share gambling oversight in Nevada, though many people are not aware of the difference. The Nevada Gaming Control Board handles investigations, audits, enforcement, and is where players can file complaints.

The Nevada Gaming Commission is responsible for granting, denying, and revoking licenses and also holds disciplinary hearings.

The Nevada helpline is 1-800-522-4700, run by the Nevada Council on Problem Gambling. It's free, confidential, and staffed 24 hours a day. More detail lives on our responsible gambling page.

Where You Can Bet in Nevada

About thirty mobile sportsbook apps are available in Nevada, each linked to a specific land-based casino. New accounts cannot be created remotely; registration must be done in person at the casino before the app can be used. No other legal state requires this, which is why visitors cannot simply download an app upon arrival.

Nevada sportsbooks provide information on where to sign up and place a bet.

Paid daily fantasy sports have their own licensing process, separate from sports betting. Nevada's DFS options cover who's currently available.

There is no Nevada-specific page for prediction markets, as they are not covered by state licensing. Courts are currently debating their legal status. The prediction market regulatory tracker provides updates on their current status.

Tax on Gambling Winnings in Nevada

Nevada State Tax on Winnings

Nevada does not have a state personal income tax. Gambling winnings are only subject to federal taxes, with no additional state tax.

What Gets Withheld and When

Federal withholding applies to qualifying gambling winnings above the W-2G threshold. Non-residents who win in Nevada may still owe taxes in their home state, even though Nevada does not tax these winnings. For specific cases, consult a tax professional.

Pending Nevada Gambling Legislation

Why Nothing Moves Until 2027

Nevada's legislature only meets in odd-numbered years. There was no regular session in 2026, so the next chance for new legislation is in 2027. Currently, there are no online casino bills pending.

Prediction Markets and Enforcement

Enforcement is currently the main focus in Nevada, as new legislation is not progressing. The Gaming Control Board issued a cease-and-desist to Kalshi in March 2025, followed by civil actions against other prediction-market platforms like Polymarket.

On August 28, 2026, the Ninth Circuit ruled 3-0 in Nevada's favor, rejecting the claim that federal law overrides the state's gaming rules. This ruling included Kalshi, Crypto.com, and Robinhood, and may lead to a Supreme Court case due to a conflicting decision from another circuit.

The Sweepstakes Position

Nevada's SB 256 took effect on October 1, 2025. According to state law, any game that awards a real monetary prize is considered gaming and requires a license. Because of this, all major sweepstakes platforms left Nevada in 2025.
