Legal basis

HB 347

Gambling in North Carolina is legal for sports betting and paid daily fantasy sports only. The same doesn’t apply to online casino games. Prediction markets sit in federal territory, at least for now.

Sports betting has been live statewide since March 2024, and that makes North Carolina one of the newer full mobile markets in the country. All in all, this is exactly why so many people land here unsure what's really allowed.

Who Regulates Gambling in North Carolina

The North Carolina State Lottery Commission

So, who is responsible for regulating gambling in North Carolina? One body is to be seen here: the North Carolina State Lottery Commission. It licenses and polices both the lottery and sports betting.

If a sportsbook wrongs you, this is who you complain to.

Where to Get Help in North Carolina

The three tribal casinos answer to their own tribal gaming commissions under federal compacts. This means casino complaints go a different route entirely.

For gambling problems generally, you may always call or text 1-800-MY-RESET. This is the national problem gambling helpline, also available in North Carolina.

Where You Can Bet in North Carolina

Sportsbooks in North Carolina

Here's something many state guides haven't caught up on yet. North Carolina launched with 8 operators, but Underdog Sports pulled out in December 2025 to focus on prediction markets instead.

That leaves seven active sportsbooks in North Carolina today:

  • bet365,
  • BetMGM,
  • Caesars,
  • DraftKings,
  • Fanatics,
  • FanDuel, and
  • theScore Bet (the rebranded ESPN BET).

Every license is tied to a specific pro team, venue, or NASCAR facility, which is an unusual setup most other states don't require.

What Is Not Available Here

No online casino page exists to link you to, since nothing legal exists yet.

Same goes for regulated online poker.

Tax on Gambling Winnings in North Carolina

North Carolina State Tax on Winnings

Winnings count as ordinary income. North Carolina's flat rate dropped to 3.99% for 2026, down from 4.25%.

It's set to fall again to 3.49% in 2027. What’s more, this is based on revenue triggers that the state already confirmed it hit this spring, with 2.99% penciled in for 2028 after that.

This contradicts some pages that say this would happen immediately in 2027.

What Gets Withheld and When

Larger payouts can have state withholding applied at the time you win.

This is general information, so please talk to a professional if your situation is more complicated than a single win.

Pending North Carolina Gambling Legislation

The Online Casino Question

No iGaming bill has ever cleared committee here, and the 2026 short session didn't take one up either. Lawmakers and industry folks have been talking informally since late 2025, but nothing's moved to a real vote.

Interestingly, the state's been leaning into digital instant lottery games instead. After all, it’s a workaround that's quietly grown while the iCasino conversation stays stuck.

What Isn't Moving

Sweepstakes casinos remain legal here too. Yet, that surprises people once they learn North Carolina actually banned physical internet sweepstakes cafés years ago, a ban the state Supreme Court upheld.

That old law never touched online sweepstakes platforms played from your own phone, which is exactly why they still operate freely. As of this writing in September 2026, nothing's changed on either front.

Frequently asked questions

Is gambling legal in North Carolina?

Partly. Sports betting and daily fantasy sports are legal, run by the North Carolina State Lottery Commission. Online casino games aren't legal, and no bill authorizing them has gotten anywhere close to passing. Prediction markets are regulated federally by the CFTC and sit outside North Carolina law.

Are online casinos legal in North Carolina?

No. North Carolina has never authorized online casino games. Land-based casino gaming stays tribal-only, at Harrah's Cherokee, Harrah's Cherokee Valley River, and Catawba Two Kings. Sweepstakes casinos are a separate thing entirely and remain legal here, which is why so many operators accept North Carolina players.

Is sports betting legal in North Carolina?

Yes, sports betting is legal since March 11, 2024. HB 347 was signed on June 14, 2023, and each license is tethered to a professional sports team, a venue, or a NASCAR facility. Know that 7 operators are currently live, including FanDuel, DraftKings, BetMGM, and Caesars, after Underdog exited the market in late 2025.

How old do you have to be to gamble in North Carolina?

21 is the minimum age for sports betting or a tribal casino visit. The lottery only requires you to be 18. Either way, you need to be physically inside the state to place an online wager. Every licensed sportsbook verifies your location with geolocation before accepting a bet.

Who regulates gambling in North Carolina?

The North Carolina State Lottery Commission oversees both the lottery and sports betting, and it's where you file complaints. The three tribal casinos answer to their own tribal gaming commissions instead, so casino complaints go elsewhere. Need help with a gambling problem? Call or text 1-800-GAMBLER.
